Fees for Services
Initial Consultation
We recognise that sound initial advice may save considerable time and effort in managing a dispute or potential dispute.
We recommend an initial consultation to identify the most appropriate approach.
Our Appointment
Before we are appointed we will need to be satisfied that there is no conflict of interest, since it would be unacceptable to our professional approach to give advice to opposing parties in the same dispute. We will therefore require details of the parties involved and the project. We will then carry out the necessary internal check.
If there is no conflict of interest, and at our sole discretion, we shall then give advice.
We give notice that the terms of our appointment can be viewed at Terms of Appointment. We draw attention to Clause 13 which limits our liability and the Appendix 1 which explains the status of Daniel Atkinson as a Barrister.
Fixed Fees
Our experience and efficiency allows us to offer fixed fees on a case by case basis.
Conditional Fees
In some cases we will act on the basis of conditional fees. We refer to the article "Contingency
Fees" for a discussion of decided cases in this area.
Recovery of Fees
Who pays the parties fees depends on the terms of the contract, the method of dispute resolution and in most cases the outcome of the dispute resolution
process.
If any recovery is possible then appropriate records need to be kept and representations made to the appropriate tribunal for the level of recovery.
